D E Officiating

In Punjab Circle, From January 2010 DE Officiating is not being given to the eligible S D Es due to some court case in the Haryana Circle. Four out of 35 respondents, from Haryana Circle are now working/posted in the Punjab Circle.The CGMT Punjab circle is not party in that case. The Respondents are CMD, CGMT Haryana & 35 S D Es. The Punjab Circle had withhold the officiating to the officers with the presumption that if they allow DE officiating then some S D E will file contempt of court or file another court case . To avoid that, the CGMT Punjab is not allowing officiating to the eligible S D Es. CGMT Punjab had replied in the discussion that,he is interested to allow officiating but C O New Delhi had instructed him not to give any officiating till the court case is not clear. Is this plea of the C O only for the Punjab Circle? How other Circles are allowed to give officiating in their circles.Other circles are also operating the same seniority list, from which Punjab Circle has to give LOCAL OFFICIATING to the eligible S D Es. The matter has to be discussed & resolved at C.O. New Delhi.

  1. additional information that supports the claim of honourable CS is that Supreme Court of India vide SLP no.22638/2010 dated: 28.8.2010('Petition(s) for Special Leave to Appeal (Civil) No(s).22638/2010 (From the judgement and order dated 11/05/2010 in WP No. 5133/2010 of The HIGH COURT OF PUNJAB & HARYANA AT CHANDIGARH))has clearly ordered that 'Contemp proceedings pending with the CAT will not be proceeded with till the disposal of the writ petition'
    Hence question does not arise for any contempt.
    More over there should be limit to 'Loacl Officiating' period as this is a clear exploitation of SDE cadre. ( SDEs have to work as DEs along with their exiting charge as SDE, that too without any extra monetary benefit.

  2. The present look after arrangement is really painful for the senior officers who in spite of officiating as DE for many years are retiring as SDE/DE Look after since last one year.
