RASOLUTIONS FOR C W C MEET AT KOLKATA
1, Increase of monitory limit of leave encashment of BSNL for the purpose of Income Tax:
As per section 10(10AA) of Income Tax entire payment received on account of Earned leave at the credit of Central or State Government Employees whether on Superannuation or otherwise including resignation or death of the employee is exempted from Income tax but as per Notification No S.O.553(E) dated 08-06-1988.NO 10043[F.No.200/200/106/95-IT(A-1)] dated 26-03-1996,No 10749[F.No200/23/98-IT)]dated 27-11-1998 and NO 123/2002[F.123/2002[F.No200/23/98-IT-(a-1)] dated 31-05-2002 monetary limit for other employees for the purpose of exemption of income tax was fixed Rs 300000/- from 01-04-1998 to onwards and the same has not been revised so far. Most of the employees in BSNL are absorbed from DOT and ITS officer are still working on deemed deputation in BSNL and all DOT employees working in BSNL are getting the full benefit of income tax in leave encashment. Hence the BSNL employees feel discrimination while receiving the payment of leave encashment after deduction the income tax. You are therefore requested to kindly take up the case with the Ministry of Finance to exempt entire payment of leave encashment for income tax at the time of retirement being BSNL is Govt. Organization.
2, Regarding change of date of next increment on promotion under time bound Promotion Policy:
After implementation of IDA Scale, the pay of the promote is fixed under time bound promotion only after granted one increment and the benefit of one notional increment is not given as enunciated in FR-SR .It means only one extra increment is granted at the time of promotion .The BSNL has already clarified vide letter No 400-175/2007-pers.1 dated 23rd June 09 that at the time of granted extra increment the next date of increment remained unchanged. It is therefore requested to take up the case with the corporate office issue to clarification for date of next increment on fixation of pay on promotion in all cases.
3, V R S for the employees should be linked with the REQRUITMENT of the wards of the employee who opts the VRS:
We are opposing the V R S why? VRS should be introduced and linked with the recruitment of the ward of that person who opts for the VRS. In any recruitment 10% of the obtained marks, should be added to make the total marks secured by the candidate whose father / guardian opts for the VRS. If that candidate (whose father applied for the VRS) not selected then VRS should be allowed to be withdrawn.
4. 20% Reservation in the Recruitment for the BSNL employees:
At the time of recruitment of any post, 20% vacancies should be reserved for the BSNL employees. This will increase the efficiency as the selected candidates will serve the BSNL with more energetically and more vigorously as they feel the company of their own as their elders had served and nourished the BSNL.
5. DE Officiating in Punjab Circle: From January 2010 the officiating is not being given to the S D Es due to some court case in the Haryana Circle. Four respondents from Haryana Circle are now working in the Punjab Circle; But the CGMT Punjab is not any party in the case. The Respondents are CMD, CGMT Haryana & 35 S D Es. The Punjab Circle had withhold the officiating to the officers with the presumption that if they allow DE officiating then some S D E will file contempt of court or file another court case . To avoid that, the CGMT Punjab is not allowing officiating to the eligible S D Es. CGMT Punjab had replied in the discussion that, He is interested to allow officiating but C O New Delhi had instructed him not to give any officiating till the court case is not clear. Is this plea of the C O only for the Punjab Circle? How other Circles are allowed to give officiating in their circles.Matter to be resolved at C.O. New Delhi.

Subject: Tenur tarnsfer of the executives posted in J & K Circle.
Sir,
Please take up the cases of the executives posted in J & K Circle as hard tenure Station Posting.
1, Some executives of Punjab Circle had transfered to J&K Circle as hard tenure station transfer. Now ruling had changed, the hard tenure station posting tenure had been redefined from TWO year to ONE year. The officers posted in J&K Circle during the transite period of tenure change , are not being considered for the transfer to their request stations after the complition of ONE year. Where as the officers transfered after that are being considered for the transfer after ONE year. This is grave injustice with the senior officers posted there and joined a long back in the interest of the BSNL and served the MOTHER LAND ignoring their families and self life. As the life is alwayes at stake there.
2, Secondly , in J&K Circle the sanctioned posts of DEs are only 11. The working strength of DEs is 25. All 14 DEs in excess either working as SDE or without work of their post. It is very much heart burn that in Punjab Circle there is acute shortage of the DEs and the DEs in J&K Circle (from where they requested for transfer) are doing work below their post .
Please take up the issue of transfer of DEs and SDEs with the higher authorties at Cor. Off. from J&K Circle to the request station after comlition of Hard Tenure posting for ONE YEAR .

Please take up the following Issues / cases of Punjab Circle for favorable consideration please.

3) Posting of Accounts officer Sales in Punjab Circle without creation of Posts.
It is brought to your kind notice that there is already acute shortage of Accounts
And Finance staff in Punjab Circle. But in most of the SSAs concerned G.M. are posting Accounts Officer sales with out the sanction of Posts. Thus the work of Finance wing is suffering very badly and all the Accounts staff are working in Punjab under pressure due to heavy rush of work.It is therefore requested to kindly take up the case with the Corporate office to Create more posts for Accounts Officer sales and Posts additional Accounts Officer in Punjab Circle to cop with the work in the interest of BSNL.
4) Non consideration the name of Sh S.C. prasher CAO staff No 82124 for the promotion of JAG of Telecom Finance despite full filling the bench marks.
The Corporate office new Delhi has issued promotion orders of 269 STS to the level of JAG of Telecom Finance on purely adhoc basis vide memo No 1-11/2009-SEA-BSNL.(Part-1) dated 28-04-2010.The name Sh Satish Chander Prashar CAO staff No 82124 has not been considered in these promotion orders where as his juniors have been promoted. As per recruitment rules of BSNL management services circulated vide letter No 400-106/2007.pers.1 dated 14-07-2009, bench mark for JAG level Officers of general category is Very Good and not more than one Good .It is pertinent to mentioned here that after receiving the copies of ACR from the Circle Office Chandigarh, it has been revealed that the ACR of the said officer for the period from 2004 to 2005 are Very Good and for the year 2008-2009 is Good. Thus this officer is full filling the conditions of bench marks for the last 5 years i.e. Four Very Good and one Good. But unfortunately he has not been promoted to the cadre of JAG of Telecom finance.
It is therefore requested to take up the case with the Corporate Office New Delhi for the promotion of aggrieved officer Sh S.C. Prashar staff No 82124.

Promotion to JAG (Adhoc)

6, Clerification of leave encashment of BSNLemployees: Now clerification for the leave encashment in the IDA scale has been given only for superannuation. But no clerification has been given for voluntarily retierment or in case of death. Matter should be persued.
7, Huge expenditure on AMCs : On one side BSNL recruiting highly qualified and well competent engineers ( JTOs) to run the BSNL .Then why huge expenditur is being incured on AMCs for the equipments. This practice of unwanted and unnecessary expenditure be stopped as the BSNLs highly skilled and able engineers can handle that very well.
8, Hard tenure transfer: Executives were posted in the hard tenure in J & K State , should be transfered to their request stations after completion of one year as per new ruling, of course they were transfered during old ruling of two years. Now a days life is very much unsecure and uncertain at that areas and more over 18 DEs are surplus / extra , against the sanctioned strength.

CWC Meeting
1, STS promotion : The officer belonging to SC/ST category promoted in the DPC of year 1994 on dated27.05.1994 and 03.06.1994 to the cader of TES Grp B are not promoted, where as the officers of DPC year 1998 are promoted keeping in view of the judgment on SENIORITY. OC promoted out of 1966 which are ranked enblock senior to other OCs of later years were all OC and the seniority was replaced by OC candidates only and there was no SC/ST officer in those 1966 who could be ranked enbloc senior to SC/ST candidates. So officers of DPC year 1994 should be given promotion as they are entitled for the vacancies as were in 1994 with other OC candidates of 1998.
2, Increase of monetary limit for TDS in respect of Leave Encashment: As per section 10(10AA)of Incom Tax entire payment received on Acct. of Earned Leave encashment at the time of retierment or othervise, is non taxable to the State or Central Govt. Employees. Where as vide notification dated 08.06.1988 and 31.05.2002 the monetary limit for the PSU/BSNL employees was fixed Rs. 3,00,000 for the purpose of Income Tax.Thus the TDS is deducted from the leave encashment beyond Rs. 300,000.This issue should be taken up at appropriate level/ ministary.
3, Promotion policy for Grup. A executives: As there is no financial upgradation or promotion policy for Grup A officers like DE and CAO.The adhoc officers are getting the financial upgradation.The issue should be taken.
4, Date of increment should not be changed at any level as at present no fixation benefit is being given to the staff at the time of revision of pay scale. Only 3% of the B Pay is being given to fix the officer in next stage. So date of incement should remains the same at the time of financial upgradation or promotion based fixation.
