Today on 17.12.2011 the 3rd circle conference of AIBSNLEA Punjab circle is held at Hotel Maharaja Palace Sutehri Road Hoshiarpur, CHQ President Sh.P Venugopal Ji ,CHQ General Secretary Sh.Prahlad Rai Ji and CHQ Org. Secy (North) Sh Divesh Sharma Ji along with 60-70 Delegates from different, different parts of the Punjab Circle Attended the Conference. GS and President discussed in detail the happening at All India Level. They also mobilize the Punjab esteemed comrades to prepare their selves for next and very crucial struggle for the viability of the BSNL. G S Also interacts with the Print and electronic media and given all detail of the in side story of BSNL which is the responsible for present circumstances and bad shape of BSNL.
Sh. Baldev singh AO (NTR) Jalandar, Sh Balwant Rai DE Hoshiarpur and Sh Kuldip Ram Sr.AO (Circle Office Chandigarh) are Elected Circle President, Circle Secretary and Circle Finance Secretary respectively.These Office Bearers along with other 12 Executive members will fuction for the next term of the Punjab Circle Association.

Sh. Sat Narain Ji CAO (Hoshiarpur) has been Elected as CWC Member from Punjab Circle . Sh Baljinder Singh SDE (Ludhiana) will also be CWC member from Punjab when ever the membership of Punjab Circle will achieve the desirable strength for the Second CWC member.

Now we are meeting for the 3rd Circle conference of Punjab Circle to day at Hoshiarpur. The all fine arrangement has been done by Hoshiarpur Friends under able leadership of Sh. BALBIR SINGH D.S. AIBSNLEA Hoshiarpur and under the guidance of Sh SAT NARAYAN Circle Pres. and Sh BALWANT RAI CHQ Executive Members from Punjab Circle. I wish the Conference a great success and request the members to Elect New Executive Body of Punjab Circle unanimously and in a very friendly and sportive manner.

Condolence :- Dear comrades during the tenure , comrades Sh N.K.Sharma CAO, Sh Rakesh Anand A.O. and others left for heavenly abode and some dignities souls from our country and world departed from us .We had paid tribute to all these departed souls and had observed one minutes silence for their soul peace.

Organization Review: - During this period I had tried my best level to mobilize the members and tried to increase the strength of the association. I visited some stations to form the branches .During the CEC meeting at Amritsar .We nominated circle president Sh Ajit Paul Sharma DGM(Fin) , Secy Sh P C Rana and Cashier Sh.Mehar Chand to form the Branch at Pathankot. But no results came out till date. I tried my best to get the membership increase in Punjab circle but I could not achieve the expected targets due to retirements, some unavoidable, unfavorable circumstances. But at Punjab Circle office Chandigarh, an independent Branch of the Association had been started functioning. This has nearly 40 members.

Staff Problems: - With the help of worthy GS the transfer case of Ex CS Sh. AK Khanna was settled. G S Sh Prahlad Rai ji and my self went to the GM Pers. In Corporate office, and fight the case with full strength and got it settled down and his transfer orders got modified from J& K to Corporate Office New Delhi.

After that the case of Sh. Nanak Chand from Chd , Mr. Chhabra from Jalan., and many more were taken and got those settled in their flavor. In the Punjab Circle taken care of all the cases those who had informed me, were got settled in their favor.

During this period I along with Circle President met the General Manager Finance to convene the DPC from E-2 to E-3 and E-4 to E-5 after long discussion the GM Finance had agreed to hold the DPC of those officers who opted the IDA scales from the date of their promotions.

The following issues were taken up with the Administration through Agenda

1. Posting of I F A in the SSAs in Punjab Circle as per guidelines of BSNL Corporate Office i.e. senior most CAO/DGM may be posted as IFA.

2. Local officiating arrangement to the post of JAG in the Accounts and Finance wing of the Punjab Circle BSNL.

3. Non consideration of requests at the time of transfers of the staff in Accounts Wing of the Punjab Circle BSNL.

4. Posting of Executives as per Justification of the vacancies in the SSAs and in the Circle Office.

5. Posting of subordinate staff for the Executive at different wing like CMTS, Civil and Electrical.

Many more issues were tackled in the Circle all can not be explained here.

The following issue was taken up with the Central Head Quarters New Delhi

1. Promotion from SDE to DE and JTO to SDE on regular basis.
2. Increase the monitory limit of leave encashment of BSNL Employee for Income Tax purpose at per with Central Govt Employees.
3. Promotion of left out case of DGM Finance like case of Sh S.C. Prashar CAO Jalandhar
4. Holding of DPC for the promotion of A.O, CAO and DGM (F).
5. Holding of DPC for the promotion of SDE, DE and DGM.

Regularization of Government Accommodation to the executive which was occupied by him at the time of Hard Tenure Station Posting where he could not get the same station as per his choice of posting for some period due to administrative reasons.

Central Head Quarters Calls:-All the agitation calls given by the CHQ were implemented in the Punjab Circle in spite of the hardships and differences with our sister Association. The latest on 15.12 .201195% staff at circle office was on STRIKE. And all nonabsorbent ITS officers were forced to stay at the gate for 20 to 30 minutes.

Attended all the CWC and All India Conference at Kotkatta except CWC at Chennai in spite of the financial hard ships, in all the CWC and All India Conference at KolKata raise the voice of Punjab circle.

During the period I tried best to maintain the good relation ship with CGM Pb. This helps the association to get favorable results. Promotion order from JTO to SDE were relesed on same Day and the increase in local officiating from JTO to SDE by 20 JTO’s is the last result of efforts.

In the end I will have to mention that during my tenure I receive full Co-Operation from Sh. Sat Narain JI Circle President I Achieve A lot under his guidance. He was so submissive that at every stage he guided and fought the staff cases with full strength.

At last I have no hesitation to express that what I had achieved during the period, that is due to Punjab Circle AIBSNLEA members and what “I could not” that is due my weakness.

I hope you all will fully Co – Operate with the new Circle Secy. And achieve all the Pending and Achievable GOALS.

Respected Comrades,

At the outset and before opening the house, I welcome our beloved leadership Sh P. Venugopal ji All India President,Sh Prahlad Rai ji General Secretary and Sh Dawesh Sharma ji AGS (North) to their visit in Punjab the land of five rivers containing 50362 sq K area with 20 district. Now we gathered here at Hoshiarpur Distt to hold the 3rd Circle Conference .Dear Comrades as you well aware that Hoshiarpur is famous for gardens of mangoes, City of saints and small seasonal lakes which we call in Punjabi Choes because this station is situated near hill state of Dev Bhoomi Himachal Pradesh. I also welcome the Circle Officer bearers and delegates who comes from the different parts of Punjab at Hooshiarpur.This place is situated near the religious places of Mata Chint Purni ,Mata Jawala Ji Baba Balak Nath ji and Dera Baba Badbhag Subgh ji.

Dear Comrades our last circle conference was held at Ludhiana on date 21-03-2009.I along with Sh Kamlesh Dadwad were elected as President and Circle Secretary respectively.Sh Baljinder Singh Janda was elected as Circle Finance Secy. During our tenure we worked together with good understanding and cordial relations.Other office bearers had also extended their full co-operation including Sh Balwant Rai CWC member.I thankful to our branches i.e. Chandigarh, Jalandhar and Amritsar who conducted CEC at their stations during this period. I am also thankful to Sh Harjot Singh Distt Secy Patiala, Sh Kuldeep Ram CAO Chandigarh, Sh Baljinder Singh Janda our Finance Secy and Sh Baldev Singh A.O. Jalandhar who visited with us for KOLKATTA All India conference.

Dear Comrades we made maximum efforts to increase our membership during this period ,but due to retirements and set back due to earlier leadership as you all known well we could not achieve our target but even than the membership has been increased.

Subject: Local officiating from JTO to SDE.

Sir,

With due regards it is requested that for the local officiating from JTO to SDE in Punjab Circle, in the month of January 2012 is under process. Last time in the month of July 2011 the recommendations were called nearly for 125 JTOs. Out of these 125 candidates 8-9 were dropped in the DPC and nearly 16 candidates not joined as SDE in their station of posting. From July 2011 to Dec. 2011 nearly 20 regular SDEs are retired.

So in other words it is very clear that there is nearly 45-50 SDE are less promoted and working as per the orders released of July 2011.

It is observed that nearly 85-90 vacancies are unfilled for the SDEs . So it is requested that all unfilled vacancies be filled through local officiating as all candidates who are being considered for the local officiating, are getting the SDE pay scale, so there will be no financial implication.

Next if , some other hurdle is there then please try to maintain the working strength of SDE at par with the last local officiating orders, means nearly next 40 JTOs be included in the present list.

Actually it was double function. Ludhiana comrades have bidden fare well to their Outgoing President Sh. Nirmal Singh and Secretary Sh. M S Dhaliwal . As per Promotion orders of JTO to SDE Vide C O letter No:2-15/2011-Pers-II Dated March 30 , 2011
It is to express that there is lot of shortage of the SDEs in Punjab Circle.
The total No of Sanctioned Vacancies are 850. Present posted strength is 690.
So shortage is 160 and more over 150 SDEs are LOOKING after as DEs, without officiating orders and without any financial benefits. Total Shortage is nearly for 300 SDEs. Under these circumstances posting of 34 SDEs on promotion to NE and J&K Circle is not justified. Please take up the issue with Sr. GM (Pers.)
to post these officers in Punjab Circle only. More over when other circle orders can be modify then why not of Punjab Circle. Pl takes it most urgent and deserving.

Next I had already requested to take up the issue of Officiating DEs to the eligible SDEs as per Corporate Office List of seniority. But till date nothing has been came out.The present DEs are over burdened.

In Punjab Circle, From January 2010 DE Officiating is not being given to the eligible S D Es due to some court case in the Haryana Circle. Four out of 35 respondents, from Haryana Circle are now working/posted in the Punjab Circle.The CGMT Punjab circle is not party in that case. The Respondents are CMD, CGMT Haryana & 35 S D Es. The Punjab Circle had withhold the officiating to the officers with the presumption that if they allow DE officiating then some S D E will file contempt of court or file another court case . To avoid that, the CGMT Punjab is not allowing officiating to the eligible S D Es. CGMT Punjab had replied in the discussion that,he is interested to allow officiating but C O New Delhi had instructed him not to give any officiating till the court case is not clear. Is this plea of the C O only for the Punjab Circle? How other Circles are allowed to give officiating in their circles.Other circles are also operating the same seniority list, from which Punjab Circle has to give LOCAL OFFICIATING to the eligible S D Es. The matter has to be discussed & resolved at C.O. New Delhi.

Regarding Court case

The CAT Chennai has dismissed the court case filed by the AIGETOA Case No OA 983, regarding the foot note in the RR rules. Now the obstacles created by the younger brothers, for the time being are cleared. It is hoped that the administration will look in to the matter of promotion.

Kindly refer to letter No Staff/IF/PB/Pay Fixation2010-11/33 dated 13-01-2011 issued under the signatures of DGM(Finance) of your kind office vide which the Options have been called for from the executive of Accounts wing who were upgraded on or before 01-10-2004. In this connection, it is stated that:-
1) Calling of options at this stage are very late .Hence time barred.

2) The options have also been called for from the executive who were absorbed in the BSNL w.e.f. 01-10-2000 and opted for IDA Scales from the date of promotion as per the orders of the BSNL Head Quarters New Delhi/Circle Headquarters Chanidgarh. As such these cases does not fall under Para [1.0][1][d][7] of aforementioned letter.

3) The Accounts Cadre in the BSNL has already been declared as part of the “Organized Accounts Cadre” as such deletion of the AAO/Sr AO from the hierarchy of promotion without the consent of the C&AG of India is not lawful.

4) The case is already under consideration at BSNL Head Quarters New Delhi .The High Power Committee has been formed to look into the case of AAO/Sr AO and suggest logical solution to settle the issue w.r.t clarification No 5 of BSNL Head Quarter New Delhi letter No 400-175/2007-Pers.1 dated 19-02-2010 and all the documents have been submitted to committee by our Association.
It is therefore requested that the orders for exercising of option vide your office letter referred above either may be set –aside or postponed till the decision at BSNL Head Quarters New Delhi

RESOLUTIONS

1, Increase of monitory limit of leave encashment of BSNL for the purpose of Income Tax:
As per section 10(10AA) of Income Tax entire payment received on account of Earned leave at the credit of Central or State Government Employees whether on Superannuation or otherwise including resignation or death of the employee is exempted from Income tax but as per Notification No S.O.553(E) dated 08-06-1988.NO 10043[F.No.200/200/106/95-IT(A-1)] dated 26-03-1996,No 10749[F.No200/23/98-IT)]dated 27-11-1998 and NO 123/2002[F.123/2002[F.No200/23/98-IT-(a-1)] dated 31-05-2002 monetary limit for other employees for the purpose of exemption of income tax was fixed Rs 300000/- from 01-04-1998 to onwards and the same has not been revised so far. Most of the employees in BSNL are absorbed from DOT and ITS officer are still working on deemed deputation in BSNL and all DOT employees working in BSNL are getting the full benefit of income tax in leave encashment. Hence the BSNL employees feel discrimination while receiving the payment of leave encashment after deduction the income tax. You are therefore requested to kindly take up the case with the Ministry of Finance to exempt entire payment of leave encashment for income tax at the time of retirement being BSNL is Govt. Organization.

2, Regarding change of date of next increment on promotion under time bound Promotion Policy:
After implementation of IDA Scale, the pay of the promote is fixed under time bound promotion only after granted one increment and the benefit of one notional increment is not given as enunciated in FR-SR .It means only one extra increment is granted at the time of promotion .The BSNL has already clarified vide letter No 400-175/2007-pers.1 dated 23rd June 09 that at the time of granted extra increment the next date of increment remained unchanged. It is therefore requested to take up the case with the corporate office issue to clarification for date of next increment on fixation of pay on promotion in all cases.
3, V R S for the employees should be linked with the REQRUITMENT of the wards of the employee who opts the VRS:
We are opposing the V R S why? VRS should be introduced and linked with the recruitment of the ward of that person who opts for the VRS. In any recruitment 10% of the obtained marks, should be added to make the total marks secured by the candidate whose father / guardian opts for the VRS. If that candidate (whose father applied for the VRS) not selected then VRS should be allowed to be withdrawn.

4. 20% Reservation in the Recruitment for the BSNL employees:
At the time of recruitment of any post, 20% vacancies should be reserved for the BSNL employees. This will increase the efficiency as the selected candidates will serve the BSNL with more energetically and more vigorously as they feel the company of their own as their elders had served and nourished the BSNL.

5. DE Officiating in Punjab Circle: From January 2010 the officiating is not being given to the S D Es due to some court case in the Haryana Circle. Four respondents from Haryana Circle are now working in the Punjab Circle; But the CGMT Punjab is not any party in the case. The Respondents are CMD, CGMT Haryana & 35 S D Es. The Punjab Circle had withhold the officiating to the officers with the presumption that if they allow DE officiating then some S D E will file contempt of court or file another court case . To avoid that, the CGMT Punjab is not allowing officiating to the eligible S D Es. CGMT Punjab had replied in the discussion that, He is interested to allow officiating but C O New Delhi had instructed him not to give any officiating till the court case is not clear. Is this plea of the C O only for the Punjab Circle? How other Circles are allowed to give officiating in their circles.Matter to be resolved at C.O. New Delhi.

Please take up the cases of the executives posted in J & K Circle as hard tenure Station Posting.
1, Some executives of Punjab Circle had transfered to J&K Circle as hard tenure station transfer. Now ruling had changed, the hard tenure station posting tenure had been redefined from TWO year to ONE year. The officers posted in J&K Circle during the transite period of tenure change , are not being considered for the transfer to their request stations after the complition of ONE year. Where as the officers transfered after that are being considered for the transfer after ONE year. This is grave injustice with the senior officers posted there and joined a long back in the interest of the BSNL and served the MOTHER LAND ignoring their families and self life. As the life is alwayes at stake there.
2, Secondly , in J&K Circle the sanctioned posts of DEs are only 11. The working strength of DEs is 25. All 14 DEs in excess either working as SDE or without work of their post. It is very much heart burn that in Punjab Circle there is acute shortage of the DEs and the DEs in J&K Circle (from where they requested for transfer) are doing work below their post .

Please take up the issue of transfer of DEs and SDEs with the higher authorties at Cor. Off. from J&K Circle to the request station after comlition of Hard Tenure posting for ONE YEAR .

It is brought to your kind notice that there is already acute shortage of Accounts
And Finance staff in Punjab Circle. But in most of the SSAs concerned G.M. are posting Accounts Officer sales with out the sanction of Posts. Thus the work of Finance wing is suffering very badly and all the Accounts staff are working in Punjab under pressure due to heavy rush of work.It is therefore requested to kindly take up the case with the Corporate office to Create more posts for Accounts Officer sales and Posts additional Accounts Officer in Punjab Circle to cop with the work in the interest of BSNL.
4) Non consideration the name of Sh S.C. prasher CAO staff No 82124 for the promotion of JAG of Telecom Finance despite full filling the bench marks.
The Corporate office new Delhi has issued promotion orders of 269 STS to the level of JAG of Telecom Finance on purely adhoc basis vide memo No 1-11/2009-SEA-BSNL.(Part-1) dated 28-04-2010.The name Sh Satish Chander Prashar CAO staff No 82124 has not been considered in these promotion orders where as his juniors have been promoted. As per recruitment rules of BSNL management services circulated vide letter No 400-106/2007.pers.1 dated 14-07-2009, bench mark for JAG level Officers of general category is Very Good and not more than one Good .It is pertinent to mentioned here that after receiving the copies of ACR from the Circle Office Chandigarh, it has been revealed that the ACR of the said officer for the period from 2004 to 2005 are Very Good and for the year 2008-2009 is Good. Thus this officer is full filling the conditions of bench marks for the last 5 years i.e. Four Very Good and one Good. But unfortunately he has not been promoted to the cadre of JAG of Telecom finance.
It is therefore requested to take up the case with the Corporate Office New Delhi for the promotion of aggrieved officer Sh S.C. Prashar staff No 82124.

5, Stoppage of recovery of AAO/ SrAAOs, SDEs who have been promoted from 01.10.2000 to 30.09.2004.

6, Clerification of leave encashment of BSNLemployees: Now clerification for the leave encashment in the IDA scale has been given only for superannuation. But no clerification has been given for voluntarily retierment or in case of death. Matter should be persued.

7, Huge expenditure on AMCs : On one side BSNL recruiting highly qualified and well competent engineers ( JTOs) to run the BSNL .Then why huge expenditur is being incured on AMCs for the equipments. This practice of unwanted and unnecessary expenditure be stopped as the BSNLs highly skilled and able engineers can handle that very well.

8, Hard tenure transfer: Executives were posted in the hard tenure in J & K State , should be transfered to their request stations after completion of one year as per new ruling, of course they were transfered during old ruling of two years. Now a days life is very much unsecure and uncertain at that areas and more over 18 DEs are surplus / extra , against the sanctioned strength.

Circle President and Circle Secretary attended the 3rd CWC meeting at Goa on 17 & 18 August. Al the Issues were raised in the meeting as per discussion held in the CEC meeting at Jalandhar. In the Secretary report I raised the issue ;

1, STS promotion : The officer belonging to SC/ST category promoted in the DPC of year 1994 on dated27.05.1994 and 03.06.1994 to the cader of TES Grp B are not promoted, where as the officers of DPC year 1998 are promoted keeping in view of the judgment on SENIORITY. OC promoted out of 1966 which are ranked enblock senior to other OCs of later years were all OC and the seniority was replaced by OC candidates only and there was no SC/ST officer in those 1966 who could be ranked enbloc senior to SC/ST candidates. So officers of DPC year 1994 should be given promotion as they are entitled for the vacancies as were in 1994 with other OC candidates of 1998.

2, Increase of monetary limit for TDS in respect of Leave Encashment: As per section 10(10AA)of Incom Tax entire payment received on Acct. of Earned Leave encashment at the time of retierment or othervise, is non taxable to the State or Central Govt. Employees. Where as vide notification dated 08.06.1988 and 31.05.2002 the monetary limit for the PSU/BSNL employees was fixed Rs. 3,00,000 for the purpose of Income Tax.Thus the TDS is deducted from the leave encashment beyond Rs. 300,000.This issue should be taken up at appropriate level/ ministary.

3, Promotion policy for Grup. A executives: As there is no financial upgradation or promotion policy for Grup A officers like DE and CAO.The adhoc officers are getting the financial upgradation.The issue should be taken.

4, Date of increment should not be changed at any level as at present no fixation benefit is being given to the staff at the time of revision of pay scale. Only 3% of the B Pay is being given to fix the officer in next stage. So date of incement should remains the same at the time of financial upgradation or promotion based fixation.

It is surprised that D A has been increased only by 0.3% w e f 01.07.2010 from 34.8 % to 35.1 % there might be some error in calculations as the PRICES of ALL commodities are sky touching.
